A Unique Regulatory Model in the European Landscape
Introduced in 2000, the Italian qualification system represents a distinctive regulatory framework with no direct equivalent elsewhere in Europe.
The system is governed by the Public Contracts Code (Legislative Decree No. 36/2023), its technical annexes—most notably Annex II.12—and the implementing regulations issued by ANAC.
CQOP SOA operates as an authorised certification body, subject to ANAC’s supervision, and ensures that qualification procedures are conducted in a compliant, transparent, and structured manner.

The Role of ANAC
ANAC (Italian National Anti-Corruption Authority) is an independent administrative authority established to prevent corruption across all areas of public administration.

The Role of SOAs: Verification and Certification of Qualification Requirements

SOAs are the only entities legally authorised to issue SOA certification, which is a mandatory prerequisite for participation in public works tenders.
Within the qualification process, SOAs:
- Verify general and specific eligibility requirements
- Manage the qualification procedure in accordance with applicable regulations
- Review financial statements, workforce structure, equipment, and certifications
- Assess the professional and legal standing of company representatives and technical directors
- Analyse completed works through Work Completion Certificates (CELs)
- Transmit contracts, data, and relevant notifications to ANAC
- Issue SOA certification, valid for five years, subject to a mandatory mid-term review in the third year
The Role of Business Consultants
In many cases, companies rely on external consultants to prepare their qualification applications for submission to SOAs.
These professionals typically:
- Advise companies on the most appropriate qualification categories
- Assist in collecting documentation
- Organise technical and administrative materials
- Support companies in understanding regulatory requirements
External consultants are not authorised to verify requirements, certify qualifications, or issue SOA certificates.
These functions are exclusively reserved to ANAC-authorised SOAs.
